We attach paramount importance to the proper processing of personal data in accordance with our own values and the provisions of the applicable privacy law (including the General Data Protection Regulation).
As a result, we exercise the utmost care in the use, processing, storage and disclosure of Personal Data that we may collect during our selection process of candidates applying on our website, on a third-party website or sending us their curriculum vitae.
This Policy informs you of the means used to protect your Personal Data and your privacy rights so that you are fully aware of how and why we use your Personal Data.

Personal Data of our Candidates and Colleagues
When you apply as a Candidate with Business & Engineering Solutions, we collect your Personal Data directly from you, from your professional and/or academic references, from other web sources (e.g. LinkedIn) and from your curriculum vitae. Our clients may request additional Personal Data about you in connection with their vacancies and requirements, such as copies of your ID card or diplomas, etc.
We make sure to limit the information we collect and use only the bare essentials. However, categories of Personal Data that we may collect include:
• Your identity, gender, date of birth and marital status;
• Your contact details including your email address, mailing address and telephone number;
• The criteria, preferences and expectations related to your job search;
• Your education;
• Your professional career and any references you may have;
• Your skills and competences;
• Your identity card and / or work permit (which could include a photograph), your nationality, your place of birth, your driving license, etc. (in accordance with the legal provisions);
• Your current compensation and benefits.
In the event that you provide us with information about a third party, we will assume that the relevant third party has given you permission to do so.
When we sign an employee contract in Business & Engineering Solutions, we collect certain Payroll-related Personal Data such as:
• Your bank details: IBAN/RIB (so that we can make payments in your favor and provide proof);
• Your social security number, date of birth, marital status (to create your Dimona file);
• The composition of your family: name(s), first name(s), date(s) of birth, professional occupation(s) (for hospitalization and group insurance purposes);
• The name of a person to contact in case of emergency.
Any information concerning your health and/or your criminal record will only be collected and processed if it is necessary, in accordance with the applicable legal provisions.
I. Use of your Personal Data
We use, process, store and disclose your Personal Data and other data that we collect in particular during the Candidate's registration process, in order to provide you with opportunities either as a Business & Engineering Solutions Consultant, either under a determined or permanent contract with one of our customers.
We will also process your Personal Data to produce statistics, analyze the effectiveness of our marketing campaigns and the number of visitors on our site. In this case, we will make your Personal Data anonymous so that they can no longer be associated with you and that no one can identify you.
II. Disclosure of your Personal Data to Third Parties
Insofar as that is necessary or appropriate, Business & Engineering Solutions may disclose your Personal Data to third parties in the following circumstances, without notice to you:
• Clients: As part of our Consultancy and/or Recruitment & Selection activity, we send our candidates’ profiles to our clients by removing personal details, but mentioning the names and surnames, education, career path, qualifications and skills.
• Third-party in the event of legal requirements: We may disclose your Personal Data to governmental agencies, including to the Police and other law enforcement agencies, or to credit control agencies etc. under applicable law.
• Company Transactions: Personal Data may be disclosed as part of a merger, sale or transfer of the assets of Business & Engineering Solutions. In addition, we may in time acquire or merge with other businesses. If that was the case, we would notify you.
• Third-party suppliers: We solicit third parties, at any time, in order to offer our Products and Services, these include:
o Companies and individuals who provide services for us. For example: the provision of services relating to the remuneration of our employees, hospitalization and group insurance, the storage of data in our CRM on our server, etc.
o IT consultants who are developing on our computer systems, service providers we could designate for data processing, etc.
o the authorities responsible for processing your Personal Data for their own purposes in the context of taxation (e.g. local tax authorities, etc.). We may not be able to impose obligations or restrictions on such responsible bodies with respect to the manner in which they treat your Personal Data.
As part of their offer of services, they may consult, receive, store or process Personal Data on our behalf. Our contracts with these service providers do not provide for the use of this data for their marketing purposes. In compliance with applicable legal requirements, we take commercially reasonable steps to require our third-party suppliers to adequately protect your Personal Data and only process it in accordance with our instructions.
III. Maintain the Security of your Personal Data
We have implemented appropriate security measures in our CRM to prevent Personal Data from being accidentally lost, used, obtained, modified or disclosed in an unauthorized manner. In addition, we restrict access to your Personal Data to employees, agents, contractors and other third-parties who have a need to do so in connection with our business.
In the event that you request changes, consultations, or other of your Personal Data, we may ask you for additional information in order to:
- confirm your identity to ensure your right of access and not disclose your Personal Data to anyone other than the person who has the right to receive it;
- verify the veracity of the newly provided information to prevent certain critical information (such as your bank account) from being incorrectly adapted.
IV. Duration of Retention of your Personal Data
Business & Engineering Solutions will keep your Personal Data as long as necessary to fulfill the purposes for which it was collected. This means that we will keep your Personal Data for the duration of your relationship with us and while we provide you with job search services.
If you have not been hired by Business & Engineering Solutions or by one of our clients, your data will be stored for up to two years after the last contact. At the end of this period, you will be contacted by email asking for your updated curriculum vitae, as well as the written permission to extend the retention of your data for a further two years.
If you have been hired by Business & Engineering Solutions, your data will be retained for up to five years after the end of our collaboration agreement. At the end of this period, you will be contacted again and will be able to decide if you wish to continue being registered in our database as a candidate, supplier or potential customer. In any case, your personal data will be stored in accordance with the law and the limitation periods compelling us to keep your personal data for a longer period, e.g. to defend us in case of lawsuits.
V. Response Times and Fees
We try to answer any legitimate request within a month. The answer could take more than a month if your request is particularly complex or if you have multiple requests. In which case, we will keep you informed.
You will not have to pay any fees to exercise your rights. However, we may charge you a reasonable fee if your request is unfounded, repetitive or excessive. In these latter cases, we may also refuse to comply with your request. In any case, we will notify you before any costs are incurred.
VI. Links to other Websites
Our website may contain links to websites, plug-ins, and third-party applications. Clicking on these links or establishing these connections may allow these third-parties to collect or share data about you. We do not control these third-party websites and we are not responsible for their privacy policy.
Legal Rights
Subject to the conditions set out in applicable law, you have the following rights with respect to our processing of your Personal Data.
I. Your Specific Rights
• Right of access: You have the right to obtain at any time a copy of your Personal Data and to verify that we treat them lawfully;
• Right to portability: To the extent that your Personal Data is processed using automated processes, you have the right to receive it in a structured, commonly used, machine-readable format, and to obtain that we forward them to another personal data controller when it is technically possible;
• Profiling and manual processing of data: All Business & Engineering Solutions decisions are based mainly on the personalized processing of your Personal Data by our internal staff;
• Right of modification: You have the right to ask us to modify, correct or complete your Personal Data. Business & Engineering Solutions is committed to taking all reasonable steps to ensure that your Personal Data is accurate and complete. We invite you to inform us of changes in your situation (change of address, etc.);
• Right to limit the use of data: You have the right to limit our use of your Personal Data when (i) you dispute the accuracy of such data or when (ii) we no longer require personal data for the relevant purposes invoked, but you need it necessary for the establishment, exercise or defense of legal claims;
• Right to withdraw your consent: For the use and the storage of your Personal Data. However, this will not affect the legality of any treatment performed prior to the withdrawal of your consent. If you withdraw your consent, we may no longer be able to provide you with certain services. We will notify you if this is the case when you withdraw your consent;
• Right to erasure: You have the right to demand the erasure of all Personal Data that we hold about you when such data are no longer necessary for the purposes for which they were collected or when you remove your personal data consent and that there is no other legal basis for the treatment. If you have such a request and all the requirements are met, we will make sure to erase the data that we are not required to keep in the light of a legal obligation. Should it occur, we would notify you at the time of your request;
• Right of objection: To the extent that we invoke our legitimate interests in using your Personal Data, you have the right to object to such use and we are required to stop such processing until we can demonstrate that there are legitimate and compelling reasons for the use that prevails over your interests, rights and freedoms or for the contestation, exercise or defense of rights in court;
• Right to lodge a complaint: You have the right to lodge a complaint with a supervisory authority, in particular in the Member State in which your residence is located, if you consider that the collection and use of your Personal Data is the subject of a violation of this Privacy Policy or applicable law.

Personal Data of our Customers and Suppliers
If you are a Customer or a Supplier of goods and services, we will collect and process the data of our contact persons within your organization to provide our services or receive goods and services related to our collaboration. In general, we only deal with the name and contact details of the people involved.
We are required by law to retain certain information about our Clients and Suppliers (including contracts, proof of identity, financial and transactional data) for up to 10 years after the termination of our relationship, subject to regulation and for tax purposes. In any case, your personal data will be stored in accordance with the law and the limitation period, which compels us to keep your personal data for a longer period, e.g. to defend ourselves in case of lawsuits.
Returns and Claims
You have the right to make a complaint at any time to the Belgian supervisory authority for data protection issues, the Belgian Data Protection Authority (DPA) (autoriteprotectiondonnees.be).
